California Supreme Court will decide whether cities can legally use zoning codes to prohibit marijuana dispensaries as Lake Forest has done.
A ruling in favor of a Lake Forest medical marijuana collective is on hold after the California Supreme Court on Wednesday granted a petition from the city to review the decision. The state Supreme Court agreed to hear a case about whether cities can use their zoning codes to prohibit dispensaries as Lake Forest has done, according to City News Service. The decision puts on hold the lower court's decision in favor of Evergreen Holistic Collective, issued in February, until the state's highest court rules. In the meantime, the Lake Forest City Attorney's office plans to resume prosecuting the dispensaries under the city's zoning code, according to a statement released this afternoon. Grading could begin as early as September on land for thousands of new homes as the long-awaited Shea Baker Ranch housing development gets underway. After expressing appreciation for the patience of developers, the Lake Forest City Council unanimously approved the project Tuesday evening. "We feel like we're here at the cusp of a milestone," said Bob Yoder, division president of Shea Homes. "We're really trying to build something special for the city." Have you seen the new children's card for the Mission Viejo Library? The design, a tree with multicolored triangles for leaves, was chosen among 185 entries. And the big winner was Mia Ross, a student at Ladera Ranch Middle School. Mia won an ice cream party for 10 from Farrell's. An analyst hired by environmentalists says the steps being taken by Southern California Edison won't work.
San Onofre could be on ice for 18 months before technicians finally fix the faulty generators that leaked radioactive steam in January, according to a report issued Tuesday by Fairewinds Associates, an energy consulting firm hired by an anti-nuclear group. "The damaged steam generators ... require major modifications with repair and outage time that could last more than 18 months if [Southern California] Edison and [generator manufacturer] Mitsubishi are even able to repair these faulty designed steam generators," the report states. The report, commissioned by the environmental group Friends of the Earth, said replacing the steam generators is the only real solution to the problem. If voters shoot down a November initiative to temporarily raise taxes, school districts statewide would face $5.5 billion in cuts, about $700 million worse than what the governor estimated in January.
Gov. Jerry Brown continues to lay his hopes for state fiscal soundness on a November tax initiative, but if it doesn’t pass, schools will face additional cuts that could chop three weeks off the next school year. On Monday, Brown revised the 2012-13 budget he first released in January. Called the May revise, his new figures reflect tax revenues that have fallen far short of earlier predictions. “It’s a difficult budget,” Brown acknowledged in a press conference. If voters approve his temporary tax hike measure, Brown’s revised budget would actually increase funding for schools by $15 billion in four years, or $2,500 per student. A sports training company is interested in using an industrial building in Lake Forest for private baseball and softball lessons. The business, Primus Sports Performance, plans to use the facility at 20451 James Bay Circle to train athletes from 12 to 18 years of age who play on competitive softball and baseball teams. Primus Sports would provide lessons for individuals and team training sessions by appointment only, seven days a week. While the building has batting cages, they are not for public recreational use. Two Fullerton police officers were ordered today to stand trial for the beating death of schizophrenic transient Kelly Thomas. Officer Manuel Anthony Ramos, 38, is charged with second-degree murder and involuntary manslaughter, while Cpl Jay Cicinelli, 40, is charged with involuntary manslaughter and excessive force in the beating last July 5 at the Fullerton Transportation Center. The 37-year-old homeless man died five days later when his family took him off life support. The 38-year-old Ramos, a 10-year Fullerton police veteran, is free on $1 million bail, one of the highest ever posted in Orange County. Cicinelli, 42, is free on $25,000 bail. With a backdrop of earthmovers and an unpaved stretch of road, Lake Forest officials held a midafternoon groundbreaking ceremony Tuesday to mark the beginning of the Rancho Parkway project. Though work has already gotten under way on the roadway extension—which will lengthen the thoroughfare through to Portola Parkway—officials picked up ceremonial gold shovels at Rancho's current Hermana Circle end to turn a little dirt and officially mark the project's start. Once complete, the extended Rancho Parkway will provide access—or a "gateway," as officials have dubbed it—to the city's future sports park.
