Two More Medical Marijuana Dispensaries Sued by City of Lake Forest

World Cann Wellness Center and Patient Farmers Cooperative are the latest targets of litigation.

The list of medical marijuana dispensaries sued by the city of Lake Forest has grown by two, with attorneys for the city filing dual compaints against two shops March 7.

World Cann Wellness Center at 26240 Enterprise Court and Patient Farmers Cooperative at 20770 Lake Forest Dr., Suite A, are targeted in the complaints, as is David H. Tayyanipour Trust, which is alleged to be World Cann Wellness Center's landlord.

The suit is the latest effort in a battle by the city against marijuana dispensaries in town. In 2009, the city filed suit against dispensaries, and in May 2010 a judge handed down an injunction allowing the city to shut down 11 of them. An appeal from five dispensaries has stalled that injunction from taking effect.

, Pharmer's Choice Collective at 24602 Raymond Way, Suite 202, and Lake Forest Discount Caregivers, also known as 1 AM LFDC at 24602 Raymond Way, Suite 207, were both named in similar lawsuits filed by the city. Also named were Youseff Ibrahim and H&H Investments, LP, the owners of the property, according to the city.

The city is suing the dispensaries on the grounds that they are not allowed for by city zoning and because they pose a public nuisance.  "Defendants' use of these properties is injurious to health, is indecent and offensive to the senses, and is an obstruction of the free use of property," wrote the city's lawyers in both complaints.

The requested remedy is a temporary restraining order, preliminary injunction and permanent injunction to stop the sale, cultivation and distribution of marijuana and to close the stores down.

"Over the past year, the city has been consistent in its message to potential business operators, leasing agents and property owners that marijuana stores violate the city's zoning code and are not allowed in Lake Forest," said Mayor Peter Herzog in a statement released in December. "We have been very clear that if additional marijuana stores are discovered, further complaints would be filed."
